How to Sue A Telemarketer by Stephen Ostrow, Esquire

The vast majority of people dislike telemarketers. While we know that it is a job and people need to work and make money, but do that have to call and bug me at the worst possible times – to make a living? Some people seem to have unreal timing – where they always call or show up at the worst possible time. Telemarketers are like that – they almost always call at a bad time – like at meal time or when we’re racing to get ready to go out.

It seems that telemarketers are here to stay. Even with the “do not call” list – we still get telemarketer phone calls. So, is there anything we can do about telemarketers? And, while many people may dream of suing telemarketers, is it a legitimate option? Attorney, Stephen Ostrow gives us the answer in his book which gives valuable details about how to handle telemarketers, along with the legal perspective peppered with his own unique brand of humor.

I’ll admit up front that I hang up on telemarketers. I feel no shame or embarrassment about this and I don’t apologize for it. Yes – I have had them call me back and claim that we were disconnected. Being me, I hang up on them again. I know people who pay for caller ID or refuse to pick up “out of area” or “caller unknown” calls, because it may be a telemarketer. It seems ridiculous that people feel the need to act like this and it amazes me that more people don’t hang up on them.

For about two weeks I was a telemarketer for a local newspaper and I promised myself that I would never do that again – thankfully I haven’t needed to resort to that work. But there are plenty of people who work as telemarketers to put food on their tables and to keep a roof over their head. So, how can we deal with telemarketers and what can we do legally when telemarketers do cross the line? Those are two of the reasons why you need to read Stephen Ostrow’s book How to Sue a Telemarketer.

On the very first page Ostrow tells the reader that picking up this book is proof that they have decided to stop being a victim of telemarketers and to be pro-active about “reclaiming the sounds of silence”.

Through the pages of his book, Ostrow gives specific examples of how to handle telemarketers. This includes the information you need to get from them, whether you can record them, how to record them legally, what to do and who to reach out to if they do cross the line and much more. He also explains the laws regarding telemarketers and when you do have a legal recourse against them.

Each chapter is packed with information on what to do and there is a “Check List Review” at the end of each chapter to make sure you got the points. I like simple reviews at the end of each chapter and especially since my reading time is often interrupted – it helps me be sure that I got the points. I know many other people have plenty of interruptions when they try to read too.

Vinita is a young woman in contemporary India and the captain of the college cricket team pays attention to her. For a very focused student, that is overwhelming and she simply has to make any adjustments in her life to enjoy his attention. They start off with innocent cups of coffee in a local coffee shop, but things turn more serious and intimate. Vinita is from a strict Indian family and she knows that her behavior isn’t “approved”, but she’s young and “in love”.

She has to tell her parents.  It goes as bad as she feared and her older brother is called home to help them deal with the “situation”. Vinita goes to live with her brother until the baby is born and her mother comes to be with her for the baby’s birth.

Vinita is insistent that she will keep her baby and raise it on her own – totally against her family’s wishes. She is very sick when she goes into labor and her body is too weak to get through a difficult delivery. So, the doctor, a friend of her brother’s, suggests a C-section. Eventually, she is too weak to argue. Hours later when she wakes, Vinita is told that her son didn’t survive. Imagine the guilt of a young mother who was too sick to delivery her baby, who made the decision to try to have the baby naturally and then she learns that he died.

Time passes and Vinita’s family eventually finds a marriage match for her and she moves to the United States to start a new life and a family with her husband.  Her life is happy and she loves her husband and her daughter. Things are good in her new life until an unexpected letter arrives – it says that her son is very sick and may not survive. Obviously she is confused – then she speaks to her brother who admits her son didn’t die all those years ago. As she tries to grasp the truth, she must face the fact that her husband and daughter don’t even know she was pregnant. How can she tell them that she lied to them?

That letter sets of a chain of unexpected and emotional events for Vinita, her husband, her daughter, her parents, her brother and sister in law. In addition, she is caught in the middle of an unexpected “turf war” in her home town.

Glamour Girl From the Stars by Carlton Scott

As a young girl – I was always taller than everyone my age. That makes a person very self conscious and we all want to fit in – especially as a child in school. The height “issue” has always been a part of my life and I finally got to a point where I accepted it when I was working with a group of people who were all my height – and taller :)

So – I could definitely relate to PleeDee the Glamour Girl from the Stars. Can’t relate to the intergalactic part – but wanting to fit in and wanting to feel good about herself.

She is a girl that hears about the Miss Universe pageant and being an intergalactic girl – she thinks that there will be young girls from all parts of the universe. That seems like a logical assumption.

PleeDee borrows her father’s flying saucer – a girl has to have transportation to get to the Miss Universe pageant. She overshoots 2010 in her enthusiasm and ends up meeting dinosaurs, so after making a few adjustments, she reached 2010. Since she’s come so far, she visits various places on earth, including: Las Vegas with the glitz and Elvis impersonators, she gets away from Area 51 by heading to Hawaii with the sandy beaches and surfer dudes, she visits the Great Wall of China, visits the coliseum in Rome, and even stops off for some spaghetti.

Eventually she reaches Los Angeles, California and she is surprised to see that all the people in the competition are “only tall hungry females”. This is quite a sight for a young girl who is 3’2″ and wears size ten shoes. Looking around at the people in the pageant, she realizes she is a winner too – “or at least number two!”

As she gets back in her father’s flying saucer to go home, she understands that “when little girls live up to their potential, wherever they are, they’ll shine brightly with confidence, no matter how near or far.”

She learned a valuable lesson that all young girls and boys – and older boys and girls need to learn that they don’t have to look like everyone else to be special. Living up to their potential and excelling in their own lives is a great way to feel good about themselves.

This 3’2″ girl with green skin and size 10 shoes feels like a winner at the Miss Universe pageant, she sets a great example of children of all ages, shapes, genders, backgrounds and many other things that make us different from other people.

How can you help the children in your life feel better about themselves, to see they don’t have to look like everyone else and to understand who they are on the inside is even more important than how they look? Maybe PleeDee’s story will help them start to understand they “are a winner – or at least they are number two” — and that’s a good thing :)

Keeping the Wolves at Bay: Media Training by Jonathan Bernstein

It seems that every time we turn on the news, there is a new scandal. It may be a celebrity marriage on the rocks, a fading star in trouble again with the law, a politician being accused of breaking the law or international companies dealing with a catastrophic disaster – all these people have one thing in common. They need to handle the crisis and that means handling the media. What better resource to understand the process than a crisis management expert.

Who hasn’t had an interview that they feel like they messed something up? Even when the interview is about good news or positive things, it is still possible and likely that something won’t go “right”. So, imagine the possibility of saying something wrong if it is bad news or a crisis.

I really like how this book goes through every step and its easy to understand. That does not mean is overly simplified – but you can go into this book with limited know how and understand how media and interviews work.

We have all seen people that are very skilled with the media and who give awesome interviews. Let’ be serious – most people aren’t like that naturally, but YOU can learn how to handle the media and how to give a great interview, even in a crisis.

Bernstein takes you into the mind of the media – it is beneficial to you to understand the person and the mentality they bring to an interview. I love that he moves into talking about how important attitude is – and keep that in mind as you learn about the conundrums of media relations. Before you start an interview – check out page 25 and go through the pre-interview relaxation exercises. I know that any time I have an interview, I’m a nervous wreck for a little while – but as soon as I can relax, the interview goes fine. This was something I have had to do whether I’m interviewing someone or if I am being interviewed.

The Three C’s of Crisis Communication: Compassion, Competence and Confidence.  He gives us the awesome example of Rudy Giuliani on and after 9-11. Who doesn’t remember his composure, how he communicated with the people and the media, we saw his compassion and his passion about the situation and finally, we saw his quiet confidence in this unimaginable disaster. Who of us could handle that situation with those same qualities?

We dig into how to talk with saying a word. We reveal so much by the way we stand, how we hold our arms, our eyes and expressions and so much more. Look over this section and I would recommend practicing in a mirror. Once you have your presentation down pat – review the section about delivering your message.

If you aren’t already convinced that you need to read this book – you only need to peak at pages 34 to 37, where you will get the 15 Keys to Media Interviews. This section should be made into crib notes to take with you to an interview.

When you are in a crisis – honestly, you need to be prepared for tough questions. That makes the “Guidelines for Confrontational Interviews” and “Question Turnaround” sections critical. How many times have you gotten a question and you cannot think of any way to make your answer sound positive? This section helps you learn how to turn any question to your advantage. Also, think about how a normal interview can turn into a crisis if you don’t handle the interview right? In the age of YouTube, how many people have said something they regretted in an interview, only to find out that it’s the latest hit on YouTube. Do yourself and your business a huge favor, invest in positive media relationships – by buying this book today. Jonathan Bernstein is the owner of Bernstein Crisis Management and he proves in the pages of this book, why he is the man to call when you have a crisis. In the mean time, read this book and prepare yourself on how to deal with media interviews and keep Jonathan’s number in your rolodex when things hit crisis mode.  Now it is time for me to go back and read the book again – there is far too much information to absorb all the suggestion and details the first time you read this book.

In the first part of the book, Charlotte Reznick shares her tools on how to help your child not only survive in a stressful  and difficult world – but it can help them to thrive – without drugs. Learn what tools she recommends – help your child learn to be creative and to use their imagination to the full. I love the technology that we have, but too many children and adults don’t show a lot of creativity. As a child and adult, I loved being creative and have always used my imagination – maybe too much.

Some of the conditions and ailments that these tools can help you with, include: stress induced headaches and stomachaches, bed wetting, inability to sleep, problems as school, problems with siblings, trouble concentrating, frustration ,anger issues, dealing with death or divorce, panic attacks, social anxiety, and much more.

Dr Reznick shares each tool – explains the details of each tool, explains how to prepare your child, provides notes to help you through the process with additional notes and she provides variations of each tool that you can use. She explains how children use each tool and gives troubleshooting tips. The book provides all of these details for each tool.

After you read Part One and learn about the tools that Dr Reznick uses, move to Part Two and learn how she uses these tools to help the situations listed above.

I love the title of Chapter 5 – Everyone Deserves to be Happy. That is so true and we especially want our children to be happy and to help them move forward in life on the right foot.

In each chapter in Part Two – you see the instructions on how to put the tools to work, but that is just the beginning.  I love to see unique features in non-fiction and Dr Reznick provides these. She provides: quick tips to help you and your child, backtrack alerts and detailed “how to” instructions. While I appreciate all these elements, the backtrack alerts are wonderful – Dr Reznick gives you things to look for to see if you child is losing ground. This is wonderful and I think very beneficial because we all know how hard it can be to see changes in a person when we are around them all the time, but these are additional red flags to watch for and to understand there is a problem.

I think any parent, advisor, counselor, aunt, uncle etc who loves and helps children needs a copy of this book – and they need to read and use it. In closing, I have to share this quote from an 11 year old boy – to me, this proves this young man understands. He said, “The only way to love yourself is to believe and believe in yourself”.

Bones of Betrayal by Jefferson Bass

I just completed the 4th book in the Body Farm novel series and its great. The review I read all said it was the best so far and I have to agree. I’ve enjoyed each book in this series and really enjoy the stories, the characters, the forensic details and much more.

For people who aren’t familiar with these books – they are a collaboration between Dr Bill Bass (from the University of Tennessee and the founder of “the Body Farm”) and Jon Jefferson (author, director, producer). They are both awesome people and they have collaborated on 6 books to date – unless I’ve missed any others. They have the Body Farm fiction series and also the Body Farm non fiction books – all center around Dr Bass’ experiences as a forensic anthropologist.

This is the 4th book in the fiction series and you can read each individually, but each story builds on the last and I like all the additional detail I bring to the story since I’ve read them all. BUT do NOT let that stop you from checking out this new book if you haven’t read the others. You can always go back and read them later :)

This book is set in Tennessee and it is centered around an interesting death in Oak Ridge – the home of the atomic bomb. I love novels that share real history and this book includes a lot of history and detail about what happened in this small town in the mountains in the 40s – before the bomb was dropped on Hiroshima and Nagasaki. That history is woven into the story very well and we meet Beatrice – who is our narrator about much of the intimate history that took place in her life in Oak Ridge. But I’m getting ahead of myself.

All of the Dr Bass stories include interesting and unusual deaths – but I would expect no less :) This book is no exception. In the beginning of the book, Dr Brockton (the main character based on Dr Bass) is called to a crime scene and the dead body is frozen in the water in a pool. In true Dr Bass fashion – he uses his beloved chain saw to cut the body out of the ice.  The body is removed from the pool – but the chainsaw is also lost in the pool. That is only the first mishap. The body is taken back to the morgue and during the autopsy, it is discovered that the body died from the inside out – and a radioactive pellet is discovered inside the body. That all happens in the first 4 chapters.

There are so many details I’d like to share, but I don’t want to give too much away. However I will share some tidbits -

1 – the chain saw isn’t the only thing in the bottom of the pool

2 – the radioactive pellet stirs up a series of complications

3 – there are a second and third dead body as the story progresses

4 – Dr Brockton meets a woman who looks very much like his lady love that was killed in an earlier book

5 – Miranda (Dr B’s able assistant) meets a charming young man – and they bump heads early in on

6 – a roll of film in the freezer holds clues to spies and murder

7 – Beatrice may not be who she appears to be

8 – Dr Brockton’s new lady friend has a detailed history

9 – we even get a tour of the sewer lines in Oak Ridge

Highly recommended for people who like mysteries, murder mysteries, forensic detail, historic locations and events in fiction and anyone who just likes a really good story. Can’t wait for the next book :)

Customer service and really good customer service seems to be a thing of the past in many businesses. When I was growing up – my grandfather reinforced the importance of stellar customer service to me and that lesson has served me very well of the last two decades.  This book explains how to put “heart” back into our businesses and our marketing.
